INTERNET DOMAIN NAMES MEASURES

In May, the Ministry of Industry and Information Technology (MIIT) released the draft Measures for the Administration of Internet Domain Names (Draft Measures) for comment. They regulate domain name service activities in China by registries, top-level domain name operators, registrars and root server operators, as well as resolution service providers, registration agents, reigstration data hosters and emergency backup service providers. The Draft Measures will be of particular interest to operators registering new internationalized domain names (IDNs) with ICANN. (IDNs are top-level domain names in local scripts, including Chinese characters), and wishing to operate them in China. Continue reading

MEASURES ON NEW TELECOMS BUSINESS

In April, the Ministry of Industry and Information Technology (MIIT) issued the Draft Measures on the Administration of New Telecoms Business for comment through May 28. These draft measures are intended to formalize the procedures for registering and administering new forms of telecoms business that do not fall within the scope of the Telecoms Services Classification Catalog. They apply to both basic and value-added telecoms services (i.e., from network infrastructure to Internet services). They include periodic reporting requirements and otherwise regulate the operations of new service providers. Continue reading

REAL IDENTITY AND PERSONAL INFORMATION

In July, the Ministry of Industry and Information Technology promulgated two new rules impacting information privacy – the Provisions on the Protection of Personal Information of Telecommunications and Internet Users (the Protection Provisions) and the Provisions on the Registration of Real Identity Information of Telephone Users (the Registration Provisions). These rules, effective September 1, add to the information privacy regulatory framework that China has been gradually putting in place since the late 1990s in the absence of a comprehensive privacy law. MOBILE COMMUNICATIONS RESALE SERVICES

The Ministry of Industry and Information Services recently promulgated the Pilot Program for Mobile Communications Resale Services, effective from May 17, 2013, which opens the door for private companies to resell mobile communications services. This marks the opening of one segment of the basic telecoms market in China (which includes fixed line and mobile network communication services), to private capital. The basic telecoms market is currently controlled by state-owned companies. Continue reading

CIRCULAR ON PROMOTING E-COMMERCE

E-COMMERCE TAX IN CHINA

A tax on e-commerce business, first considered in 2003, was recently raised by Jindong Zhang, chairman of the electric chain store, Suning, and is under consideration by several departments in the PRC government under the lead of the Ministry of Commerce.  China’s online shopping industry has overtaken Japan’s and is expected to exceed the U.S.’s to become the largest online retail market this year.
